Local Area Plan. Meeting of Dun Laoghaire Rathdown county council.
Resolution pursuant to Section 140 of the Local Government Act. 2001, submitted by Councilors G. O'Keeffe, G. Harken and L. Cosgrave:
"We the Members of Dun Laoghaire-Rathdown county Council pursuant to Section 140 of the Local Government Act 2001 hereby require and direct the County Manager to ensure that the draft Stillorgan Local Area Plan be prepared and published ideally by the 30th April and no later than the 31st of May 2006"

The statutory process for the preparation of Local Area Plans is set out in section 20 of-the Local Government (Planning and development) Act 2000 and Amendment 2002.
A Planning authority shall take whatever steps necessary to consult with the public before preparing a Local Area Plan. The Planning Authority has already initiated the statutory plan making process, for the proposed Stillorgan Local Area Plan on 24th November 2004 with the commencement of a six week pre-draft consultation exercise. Open Days - attended by Planning Officials - were held locally during that period. 64 submissions were received. The issues were collated and a report is as presented to the May 2005 meeting of the Dumdum Area committee. Progress on the LAP preparation was postponed due to the unavailability of planning staff. Such staff have now become available once more.
The legislation states that as soon as may be after consideration of the matters arising after the consultation, the Planning Authority shall publish a notice of intent to prepare a Local Area Plan. On publication of this notice, the proposed Plan shall be put on public display. This period initiates the statutory timeframe as set out in the Act.
It is intended to submit the Strategic Environmental Assessment Screening report for the Stillorgan LAP, to the Environmental Protection Agency (EPA) in the week beginning 6th February 2006. A response is required from the EPA prior to full progression of the Local Area Plan. The minimum period for a response from the EPA is 4 weeks, in accordance with the Planning and development (Strategic Environmental Assessment) Regulations 2004. If the EPA states that an SEA is required, it is a requisite that this is undertaken during the preparation of the Plan.
Furthermore a Land Use Transportation Study (LUTS) for Sandyford and Stillorgan is currently being prepared by consultants, with a possible completion date by the end of February 2006. It will be necessary to wait for the final LUTS in order to incorporate the finding into the LAP.
Proposed timeframe:- 28/04/06 - Draft Local Area Plan complete
- Early May - Submit to Management Team - await comments and modify Plan where appropriate.
- 22/05/06 Area Committee - Submit to museum Area Committee Prepare Notice of Intent to prepare Local Area Plan, Newspaper advertisement and public display materials. Arrange venues.
- 12/06/06 Council meeting - Submit to Council
- 19/06/06 - Notice of Intent to prepare Looal Area Plan.
- 19/06/06 - 01/07/06The Local Area Plan shall be made available for inspection for a period of not less than 6 weeks
- 11/09/06 Council meeting - Not later than 12 weeks after the publication of Notice of Intent, the Manager shall prepare a report on submissions and submit to the Members.
- 09/10/06 Council meeting - Members to consider the report and make, amend or revoke the Plan within 6 weeks of receiving the manager's Report (note only 4 weeds, even the date of the Council meeting - a special meeting would be required otherwise on 23/10/06)
- 27/10/06 - If the Members modify the Plan (material alteration), within 3 weeds of the passing of the resolution the Planning Authority shall publish a notice of the proposed modification.
- 27/10 - 27/11/06 - A copy of the modification shall be put on public display for not less than 4 weeks. Submissions invited.
- 11/12/06 Council meting - Not later than 8 weeds after publication of the modifications the manager shall prepare a report on submissions and submit to the Members (Note only 6 weeks)
- 08/01/07 Council meeting - The Members shall consider the proposed modifications, make, amend or revoke the Plan within 6 weeds of receipt of the Manager's report. (note that if required, a Special meeting could be held on 15/01/07).
